In-Custody Death & Catastrophic Injury

When a person dies or suffers a life-altering injury in a Connecticut jail or prison, families are often met with silence, delays, and incomplete answers. These cases can involve medical neglect, failure to protect, excessive force, unsafe conditions, or preventable violence.

RECENT CASE EXAMPLE: IN-CUSTODY DEATH AT MCDOUGALL-WALKER (CONNECTICUT)

Warning: Some external news coverage may include disturbing descriptions or images.

Pattis & Paz LLC was retained by the family in connection with a recent in-custody death at McDougall-Walker Correctional Institution in Connecticut. Based on publicly reported information, the matter involves the death of 26-year-old Kenneth Campbell.

News reporting has stated that state police arrested Kyle McKinnon in connection with the death, and that the Office of the Chief Medical Examiner ruled the death a homicide, reporting neck compression as the cause.

This is the type of high-severity custody matter our firm reviews: a death in custody with serious questions about supervision, safety, and accountability.

In-Custody Death & Catastrophic Injury Attorneys in Connecticut

When a preventable tragedy happens behind bars

Pattis & Paz LLC represents families and seriously injured individuals in wrongful death and catastrophic injury matters arising in custody—focused on high-severity cases where the stakes (and accountability) are real.

The Cases We Focus On

We limit our in-custody cases to death and catastrophic injury. This practice area is not for minor injuries, general conditions complaints, or routine grievances.

Failure to protect from violence by other inmates

Suicide where supervision, screening, or intervention failed

Use of force incidents with fatal outcomes

Overdose or withdrawal where monitoring and care were inadequate

Policy failures (staffing, supervision, segregation practices) contributing to death

Catastrophic Injury in Custody (ICU-level injury, permanent disability)

We represent individuals (and families) when an incident in custody results in permanent, life-altering harm, including:

ICU admission, coma, or prolonged hospitalization

Traumatic brain injury (TBI), stroke, anoxic brain injury

Paralysis, spinal cord injury, loss of mobility

Amputation or permanent loss of function

Severe burns, organ failure, or lasting impairment

Permanent disability requiring long-term care

Strong Case Indicators

If one or more of the following apply, your matter may be appropriate for review:

Death in custody (including suspected homicide, suicide, or medical neglect)

ICU admission or surgery following an incident in custody

Permanent disability, paralysis, brain injury, or severe impairment

Clear timeline and identifiable facility, staff, or contractor involvement

Existing evidence (incident reports, medical records, witness accounts, video)

Accuser motives (e.g., breakup, divorce, custody disputes)

Prior warnings or documented deterioration that went unaddressed

How These Cases Are Evaluated

These cases are evidence-driven and time-sensitive. A strong claim often depends on quickly identifying:

The facility and responsible entities (state, municipality, private medical contractor)

The medical timeline (symptoms, requests for care, response delays, transport decisions)

Staffing and supervision issues (rounds, monitoring, separation/classification)

Documentation and preserved evidence (reports, logs, camera footage, 911 calls)

Frequently Asked Questions

  • What to gather before contacting us

You do not need everything, but having any of the following helps us assess your matter faster:

    • Facility name and location (Connecticut)

    • Date(s) of incident, hospitalization, and/or death

    • Outcome: death, ICU admission, permanent disability, diagnosis

    • Your relationship to the person in custody (family / legal representative)

    • Names of hospitals or treating providers (if known)

    • Any documents: medical records, incident reports, autopsy findings, letters, grievances

  • What qualifies as “catastrophic injury” for your review?

Catastrophic injury generally means ICU admission, surgery for severe trauma, coma, traumatic brain injury, paralysis/spinal cord injury, amputation, organ failure, or any injury causing permanent impairment or long-term care needs.

  • Do you handle “bad conditions” or medical complaints without severe injury?

Generally, no. We limit this practice area to cases involving death or catastrophic injury. If the matter is about conditions alone or minor injuries, we likely will not be able to help.

  • What if the facility says the death was “natural causes” or “unknown”?

Many cases start that way. A claim may still exist when there are red flags like delayed medical care, ignored symptoms, failure to monitor, prior warnings, or inconsistencies in reports. Documentation and timeline are key.

  • Can we still pursue a case if the person who caused the harm was another inmate?

Potentially, yes. Liability can exist if staff or the facility failed to protect, supervise, classify housing appropriately, respond to threats, intervene, or provide timely care after an attack.

  • What should we do right now if a loved one has died in custody?

Gather what you can (facility, dates, hospital information), write down the timeline you know, and avoid delays. Evidence can disappear quickly. If the matter involves death or catastrophic injury in Connecticut, contact us promptly for a review.
